This Telehealth Informed Consent (this “Consent”) explains how care is delivered through telehealth to patients of The Vitality Vault LLC (“The Vitality Vault”) and obtains your informed consent to receive care in this way. Please read it before you start a visit.
Who Provides Your Care
The Vitality Vault is a consumer health brand. The Vitality Vault does not practice medicine, does not prescribe, and does not dispense medication. Clinical care is furnished by the affiliated professional medical groups LFG Medical of CA, P.C., LFG Medical of KS, P.A., LFG Medical of TX, P.C., and LFG Medical of NJ, P.C. (each a “P.C.” and collectively the “P.C.s”), through clinicians licensed in the state where you are located at the time of your visit (physicians, nurse practitioners, and physician assistants). The clinician who treats you is licensed in your state and is identified by name on any prescription issued to you. Your treatment relationship is with that clinician and the P.C., not with The Vitality Vault. The technology platform and the non-clinical support behind the service are provided by Medstra Inc DBA Cuvo Health.
Services are offered on a cash-pay basis only. No insurance, Medicare, or Medicaid claim is billed or submitted on your behalf, and no controlled substances are prescribed or dispensed. If prescribed, your medication is filled and shipped by a partner pharmacy licensed by its state board of pharmacy.
Acceptance of This Consent
By clicking “I agree,” checking a box, or otherwise affirmatively indicating your acceptance, you acknowledge that you have read and understand this Consent, that you have had the opportunity to ask questions about it, and that you voluntarily agree to receive care through telehealth on these terms. If you do not agree, do not start a visit. You may withdraw your consent at any time by writing to jwdickerson33@icloud.com. A withdrawal takes effect going forward and does not affect care already provided.
Use of Telehealth
Telehealth (also called telemedicine) means the delivery of health care services and the exchange of medical information through electronic communications between you and a clinician who is in a different place than you at the time of the interaction. Care through this service may use online intake questionnaires, secure messaging, interactive audio, live video, and store-and-forward technology, which is the electronic transmission of your medical history, images, laboratory results, and other health information for a clinician to review at a later time.
These communications may be synchronous, meaning they happen in real time, or asynchronous, meaning you and your clinician exchange information at different times. Your clinician may use either method to evaluate you, reach a diagnosis, order and review laboratory testing, prescribe treatment when appropriate, follow up on your progress, and answer your questions. In some states a live video or audio visit is required, and your clinician will arrange one when that is the case.
Anticipated Benefits
Telehealth may give you access to care without travel, shorter waits for an evaluation, care from a clinician licensed in your state, and more convenient follow-up and monitoring. These are possible outcomes, not guarantees. No particular result is promised, and the benefit to you depends on your circumstances, your condition, and the professional judgment of your clinician.
Potential Risks and Limitations
Telehealth also carries risks and limitations. Your clinician relies on the information you provide and cannot perform a hands-on physical examination, so a condition may go undetected, the information available may be insufficient to reach a clinical decision, or a diagnosis or treatment could be delayed. Technical problems, including equipment failure, a poor connection, or an interruption in electronic communication, may delay or disrupt your evaluation or treatment. In rare cases, a security failure could allow an unauthorized person to access your health information. As with any medical care, a treatment may not produce the result you expect, and a medication may cause side effects.
You can reduce many of these risks by giving complete, accurate, and truthful information about your health history, current medications, allergies, and symptoms, and by responding promptly when your clinician asks for more information or laboratory testing.
In-Person Alternatives
Telehealth is not the only way to receive care. In-person services are available to you, and you may seek care in person at any time instead of, or in addition to, care through this service. Your clinician may decide that telehealth is not appropriate for some or all of your care and may recommend an in-person examination, in-person testing, or a higher level of care. You are responsible for establishing and maintaining a relationship with a local clinician who can provide in-person care, and for sharing your treatment plan, laboratory results, medications, and supplements with them.
Emergencies
TELEHEALTH IS NOT FOR EMERGENCIES. THIS SERVICE, INCLUDING SECURE MESSAGING, IS NOT MONITORED IN REAL TIME, AND YOUR CLINICIAN MAY NOT SEE OR RESPOND TO A MESSAGE PROMPTLY. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 OR GO TO THE NEAREST EMERGENCY ROOM. IF YOU ARE IN CRISIS OR HAVING THOUGHTS OF SUICIDE OR SELF-HARM, CALL 911 OR CALL OR TEXT THE 988 SUICIDE AND CRISIS LIFELINE AT 988.
Symptoms that may need immediate in-person care include, but are not limited to, chest pain or pressure, difficulty breathing, a severe or sudden allergic reaction, signs of a stroke, uncontrolled bleeding, fainting, or any other condition you reasonably believe to be serious. Do not wait for a reply through this service in any of those situations.
Data Privacy
The systems used to deliver telehealth apply security protocols designed to protect your information against unauthorized access, alteration, or loss. Protected health information that identifies you is not disclosed to third parties without your consent, except where the law authorizes or requires it, or as described in the treating P.C.’s Notice of Privacy Practices and our Privacy Policy. Information is shared only as needed to deliver and support your care, for example with the partner pharmacy that fills your prescription or the laboratory that runs an ordered test.
Email, text messages, and other electronic communications you send or receive may contain health information. No method of electronic transmission or storage is completely secure, and the security of your own email account, devices, and network is outside our control.
Your Acknowledgments
By accepting this Consent, you acknowledge, represent, and agree that:
- You are at least 18 years of age and are seeking care for yourself.
- You are physically located in the United States, and you will tell your clinician the state you are in at the time of each visit.
- The health information you provide is complete, accurate, and truthful, and you will update it as it changes.
- You understand the benefits, risks, and limitations of telehealth described above, and you have had the opportunity to ask questions.
- You understand that no prescription is guaranteed, that payment does not guarantee treatment, and that every clinical decision rests with your clinician.
- You understand that this service is not for emergencies and that you will call 911 or go to the nearest emergency room in an emergency.
Concerns and State Medical Boards
The clinicians who treat you are licensed by the state in which they practice and are solely responsible for the clinical care you receive. If you have a concern, question, or complaint about a clinician who has treated you, you may contact the state medical board in the state where you live or where the clinician is licensed. Every board maintains a free process for verifying a license and for filing a complaint, and you may use it whether or not you have raised the concern with us first. If you are not sure which board has jurisdiction, you can find your state’s board through the Federation of State Medical Boards at www.fsmb.org.
